Buying a property in Morocco can be an exciting opportunity, whether you are looking for a second home in Marrakech, a luxury villa, a traditional riad or an investment property.
For international buyers, however, understanding the local legal and administrative process is essential. One of the key differences compared with France or Belgium is the central role played by the Moroccan notary throughout the transaction.
The notary: your key partner in the purchase
In Morocco, the notary is not simply involved at the final signing. Ideally, they should be involved from the beginning of the acquisition process.
Their role is to verify that the property can legally be sold and that the transaction can take place securely. This includes checking the ownership of the property, its land registration status, existing mortgages, seizures, pre-notations or other registered rights.
The notary also reviews the property's tax and administrative situation and ensures that the necessary legal formalities are completed before ownership is transferred.
For buyers unfamiliar with the Moroccan system, having the right notary involved early in the process provides an important layer of security.
Titre Foncier: understanding the property's legal status
One of the first elements to verify when purchasing property in Morocco is whether the property is titled (immatriculé).
For a registered property, ownership is recorded with the ANCFCC — National Agency for Land Conservation, Cadastre and Cartography.
The notary will typically request a recent Certificate of Ownership (Certificat de Propriété) to verify the current legal and physical status of the property.
This document can reveal important information, including registered mortgages, seizures or other rights affecting the property.
For buyers considering a riad, particularly in the Medina, it is also important to understand the difference between a registered property and one held under a traditional Melkia. The latter requires particularly careful legal due diligence before proceeding.
What documents are checked before completion?
The exact documentation depends on the nature of the property and the seller's situation.
For a titled property, the notary will generally review:
- The property's title and recent Certificate of Ownership
- The seller's identity and ownership rights
- Existing mortgages, seizures or other registered claims
- The property's tax situation
- Planning and administrative documentation
- Construction permits and compliance documents where applicable
- Condominium documentation for apartments
- VNA documentation and planning information for certain plots of land
Additional documentation may be required for properties such as villas, riads, guest houses or properties intended for tourism.
This is why there is no single checklist applicable to every property purchase in Morocco.
Why work with a real estate agency?
A good real estate agency does not replace the notary. Instead, the two should work together.
At Arcanum, our role is to make the property search and acquisition process as clear and seamless as possible. We help our clients identify the right opportunities, coordinate with the relevant professionals and anticipate potential issues before they become obstacles.
For international buyers, this support can be particularly valuable. Buying property in a new country involves more than finding the right house — it requires understanding the market, the property itself and the legal framework surrounding the transaction.
A secure purchase starts before the signature
The most important advice for anyone looking to buy property in Marrakech is simple: do not wait until the final signing to start the due diligence process.
The property's legal status, ownership, taxation, planning situation and any specific requirements should be reviewed as early as possible.
With the right professionals around you, a trusted notary, legal advisors when necessary, and a knowledgeable real estate partner, buying a property in Morocco can be a transparent, structured and reassuring experience.
At Arcanum, we believe that our role goes beyond finding exceptional properties. We are here to help our clients buy with confidence, understand every step and make informed decisions.
